There are two parts: terms for families and terms for candidates. Both are given under the Employment Agencies Act 1973 and the Conduct of Employment Agencies and Employment Businesses Regulations 2003 ("the Regulations").
What we do
Filipina at Home is an employment agency: we introduce families to domestic staff (housekeepers, nannies and carers) who want to be employed directly by the family, and we support both sides until the placement is settled. We are not the employer, we do not supply staff under our own employment (we are not an employment business), and we do not provide care or domestic services ourselves.
"Filipina at Home" is the name of our brand. We do not select or exclude anyone on the grounds of nationality, race or any other protected characteristic.
Part 1 — Terms for families
When these terms apply
These terms apply from the moment you send us a request, write to us about a position or ask for a candidate's details, and they are the whole agreement between you and us. We will not introduce any candidate to you before you have been given these terms.
What we do for you
- We look for candidates who match the position you describe, ask them whether they are interested, and introduce the ones who are.
- Before introducing a candidate we confirm her identity, that she has the right to work in the UK, her experience, and that she is willing to take the position; we tell you what we have checked, and anything we know that could make her unsuitable.
- If she has references, we pass them to you so that you can speak to them yourself.
- Meeting candidates and receiving introductions is free.
Our fee
- If you employ or engage a candidate we introduced to you, you pay a single introduction fee equal to one month of her agreed gross salary (for a weekly salary, 52 weeks divided by 12). No VAT is charged while we are below the UK VAT registration threshold; if that changes, we will tell you before any introduction.
- The fee is due seven days after she starts work with you and is paid by bank transfer to the account shown on our invoice.
- The fee is also due if, within 12 months of our introduction, you or anyone in your household employs or engages her in any way, directly or through someone else, or if you pass her details to another person who does so.
- There are no other charges. Payroll, contract drafting, pension set-up and insurance are not part of our service; if you wish, we can introduce you to a payroll provider, whose fees are agreed with them.
Guarantee
For 12 months from her start date, if the placement ends for any reason, we will look for a replacement at no additional cost, as many times as needed. This is a replacement guarantee: the fee is not refunded and no rebate is payable.
Your obligations as the employer
You employ the candidate directly. Before she starts you must carry out your own right-to-work check. From her first day you must give her a written statement of employment particulars, pay at least the National Living Wage for every hour worked (this also applies to live-in staff), register with HMRC as an employer for PAYE, and comply with pension auto-enrolment and employer's liability insurance obligations. We give guidance, but the legal responsibility of the employer is yours.
Candidate information
Candidate profiles and contact details contain personal data of real people. They are shown to you for the sole purpose of choosing staff for your own household and may not be copied, shared, published or used for any other purpose.
Cancelling
You may cancel this agreement within 14 days of sending your request, and at any time afterwards, by telling us by WhatsApp or email. Cancelling costs nothing, because the fee is only due if you employ a candidate we introduced. Cancelling does not remove the fee described above if you later employ or engage a candidate we introduced to you.
Liability
We take reasonable care in checking the information we pass to you, but we are not liable for the work or conduct of the person you employ, which is a matter between you as employer and her. Nothing in these terms limits any liability that cannot be limited by law, and nothing affects your statutory rights as a consumer.
Part 2 — Terms for candidates
- We act for you as an employment agency: we look for families who want to employ domestic staff directly, and we introduce you to them. The family is your employer, not us.
- Our service is always free for you. We never charge you any fee for finding you work, and nobody working for us may ask you for money.
- Before introducing you, we ask for proof of your right to work in the UK (a share code or the document) and, if you have them, your references. We only introduce you to a family after you tell us you are interested in that position.
- We share your phone number and references only with a family you have agreed to be introduced to. Your public profile (first name, age, photo, experience and availability) is shown on this website; you can ask us to hide it at any time.
- Please tell us if your availability, your right to work or anything in your profile changes.
- We will tell you everything we know about a position: the family, the area, the hours, the duties and the salary offered. The terms of your employment are agreed between you and the family, and the family must give you a written statement of them from your first day.
Complaints
If you are unhappy with our service, write to info@filipinaathome.co.uk and we will answer within 14 days.
Governing law
These terms are governed by the laws of England and Wales, and the courts of England and Wales have jurisdiction. If you live in Scotland or Northern Ireland you may also bring proceedings there.
